General Terms and Conditions
1. General Provisions
1.1. Game – an agreement concluded between the Client and the company UpWin, under which the Client places a bet on the outcome of a gaming event (in slots, live games, card games, and other gambling entertainment) provided on the platform.
1.2. Outcome – the result of a gaming event, determined randomly by a Random Number Generator (RNG) or in real time (for example, in live games), serving as the basis for the Client’s win or loss.
1.3. Client – an individual of legal age who has registered on the UpWin platform to participate in gambling activities.
1.4. Gaming Session – the process of the Client participating in one or more games, during which bets are placed and outcomes are determined.
1.5. Bet Cancellation – a situation where the transaction between the Client and the platform is considered null and void (e.g., in the case of a technical error, connection failure, suspected fraudulent activity, or other circumstances provided for in this Agreement). In such cases, the bet is subject to refund.
1.6. Live Dealer Games – gambling games where results are determined in real time with a live dealer streamed via video broadcast.
1.7. Data Sources – the results and technical parameters of the game are recorded by UpWin's internal system and are final for the purpose of winnings calculation.
1.8. Client’s Obligation – in case of any questions regarding winnings calculation, the Client must submit a request to customer support within 2 (two) days, specifying the session ID, date, time, game name, bet amount, and a description of the issue. Requests submitted after this period may be rejected without review.
1.9. Winning Bet – a bet is considered winning if the outcome of the gaming event results in the allocation of winnings according to the specific game’s rules.
1.10. Game Conditions Change – rules, betting limits, maximum possible winnings, bonus mechanics, and other parameters may be changed by the UpWin platform administration without prior notice. However, changes do not affect games that started before such changes took effect.
1.11. Abuses – bets placed in violation of the rules (e.g., using bots, automation software, collusion, etc.) may be canceled, and the account may be blocked.
1.12. Claim Procedure – in case of disputes regarding winnings, bets, system operations, or other issues, the parties agree to resolve the dispute out of court through the submission of a formal claim.
1.13. Claim Submission – a claim must be submitted within 2 (two) days of the occurrence of the disputed situation. It must include a full description of the issue, supporting materials, and justification for the claim. Insufficiently justified claims may be returned without consideration.
1.14. In case of errors by the UpWin platform (e.g., obvious technical malfunctions in the RNG operation, incorrect payouts due to a system error, incorrect display of game information, etc.), or deviation from these Terms, the company reserves the right to declare the gaming session invalid. In such cases, recalculation of the bet with a coefficient of "1" and a refund of the bet amount may occur.
1.15. If there are suspicions that the Client used prohibited software, collusion, or other means to gain unfair advantages (e.g., exploiting bugs, bots, third-party software), the company reserves the right to suspend the game, block the account, and declare all related sessions invalid. Payments for such sessions may be canceled, and funds refunded at a coefficient of "1". The company is not obligated to disclose the details of the internal investigation to the Client.
1.16. In the event of an obvious error (e.g., in displaying a win, credited bonus, or multiplier calculation), recalculation may be carried out based on the correct values corresponding to the actual game result.
1.17. The company is not responsible for possible inaccuracies or discrepancies in the translation of game names, provider studio names, function or bonus descriptions. All information displayed on the platform is for informational purposes only. Such inaccuracies are not grounds for bet refunds or declaring the game invalid.
1.18. The company reserves the right to close a gaming account and cancel all sessions and winnings if it is established that the Client possessed insider or technical information that could influence the outcome of the gaming session. In such cases, the company is not obligated to provide further explanations or evidence.
1.19. The original version of these General Terms and Conditions is compiled in English. In the event of discrepancies between translations and the English original, the English version shall prevail.
2. Basic Rules for Participation in Games
2.1. The UpWin platform reserves the right to set betting limits and maximum winnings for specific games as well as for individual Clients. These limits may be changed without prior notice.
2.2. The company has the right to restrict the repeated participation of the same Client in specific game mechanics if attempts to abuse the system or bypass limits are detected.
2.3. A game is considered started after its launch and the registration of the session on the UpWin server. Once the game has started, the bet cannot be canceled or modified.
2.4. All bets must be placed within the available balance of the Client’s account. After the game starts, the bet amount is deducted, and in case of a win, the corresponding winnings are credited.
2.5. Participation in games is only allowed before the start of the corresponding game session or spin. In case of a failure causing the Client to start the game later than the scheduled time (e.g., due to lags, display errors, or technical issues), the platform reserves the right to declare such a game invalid. Exceptions apply to live games where real-time participation is possible.
2.6. Bets placed in any game mode (standard or live) cannot be edited or canceled, except in situations provided for by these Terms.
2.7. If a session must be annulled (for example, due to a technical error or violation of the rules), a full refund is issued for the session. If the game was part of a bonus activity or multi-stage draw, the cancellation of a single session may affect the overall result — this is separately described in the rules of the specific promotion.
2.8. If a session is incorrectly calculated due to a technical or other error (e.g., an overestimated win), the system may initiate recalculation. All gaming actions performed between the initial and recalculated results are considered valid. If the recalculation results in a negative balance, further participation will be suspended until the account is replenished.
2.9. For live games and other real-time activities, any suspensions, cancellations, or technical failures are resolved based on the official information provided by the game service providers (e.g., Evolution, Pragmatic, Playtech, etc.). Decisions are made based on this data and are implemented automatically through the gaming platform.
2.10. The company reserves the right to cancel a gaming session and block the account if the Client knowingly provided false information (e.g., during verification, refund claims, winnings claims, or other matters), or if it is established that a minor participated or the game was played on behalf of a minor.
2.11. A gaming session is subject to cancellation if the Client started it already knowing the outcome (for example, by exploiting bugs, technical bypasses, or if the game had already ended but the result had not yet been updated in the interface).
2.12. If the start of a live session or draw is delayed by more than 72 hours and the Client does not explicitly consent to wait, the session may be canceled and the bet amount refunded.
2.13. In case of session interruption (e.g., due to a provider’s technical failure), the calculation may be made based on the already recorded results. If no result has been determined, calculation is suspended for 48 hours. If the game is not completed within this period, the bet is refunded. Special rules may apply to live games from third-party providers.
3. Types of Game Bets
3.1. Single Bet – A bet placed on a single gaming event (e.g., a slot spin, a round in a live game, etc.). The winnings are determined according to the specific game’s rules and depend on the bet, RTP, and game mechanics.
3.2. Bonus Sessions – Gaming rounds activated using bonuses, free spins, jackpots, and other promotional activities. The conditions for winnings and calculation are regulated by the relevant bonus rules.
3.3. Progressive Draws – Some games may participate in progressive jackpots where a bet in the regular game also participates in a cumulative pool. Such winnings are subject to additional verification and may have an extended processing time.
4. Restrictions and Dependent Actions
4.1. It is prohibited to use multiple strategies simultaneously within a single gaming session that would disrupt the balance of the game mechanics (e.g., simultaneous use of bonuses and auto-play to bypass limits). If detected, the company reserves the right to exclude parts of the session from the calculation.
4.2. The use of dependent mechanics that affect each other (e.g., cyclical bets with bonus conditions designed to bypass restrictions) is prohibited. If detected, sessions may be annulled.
4.3. Bets placed on gaming actions that were not activated during the main session (e.g., bonus rounds that did not start) are considered void and may be refunded.
4.4. Gaming actions that were not activated within the declared gaming session (e.g., a bonus round, free spin, multiplier announced in bonus conditions) are considered void. In such cases, the bet is considered lost if the result depended on these unactivated conditions.
4.5. Participation in promotions, tournaments, or multi-scenario sessions (e.g., lotteries, multi-round draws) is limited to no more than 16 related gaming events within a single gameplay stream or bonus mechanic. All conditions are detailed separately in the specific promotion’s terms.
5. Participation in Live Games
5.1. Live games offer various types of bets — both basic (e.g., betting on a specific hand to win in blackjack) and additional (e.g., side bets, pair bets, etc.). A player may place one or multiple bets within a single live session.
5.2. A bet is considered accepted after its registration on the server and confirmation display in the game interface. Once confirmed, a bet cannot be canceled or changed. In case of technical failures, a refund with a coefficient of "1" may be issued.
5.3. The UpWin platform is not responsible for possible delays in the broadcast of live games, the display of current results, or dealer actions. The Client is responsible for making decisions based on the current display in the interface, considering possible technical delays.
5.4. Live bets cannot be edited or canceled. Exceptions are only possible in cases described in these Terms.
6. Game Results, Start Dates, and Disputes
6.1. If the result of a game session is incorrectly displayed due to an error by the provider or platform, it shall be reviewed based on the actual result recorded in the internal logs of the gaming provider or UpWin server.
6.2. The company is not responsible for deviations from the indicated start time of live games or bonus activities. Start times are indicative. The actual start of a session is recorded by server logs.
6.3. The company does not guarantee the accuracy of all displayed game information (including provider studio names, round duration, etc.). Clients may use additional sources (such as official provider websites) if critical for their decision-making. Claims must be submitted within 2 (two) days after session completion.
6.4. Game sessions started after an event's conclusion (e.g., activating a bonus after it expired or using a free spin outside of a promotion window) are considered void and settled with a coefficient of "1".
6.5. If it is determined that the Client performed a gaming action knowing its outcome in advance (e.g., via a bug, connection issue, or exploiting session display delays), such a bet will be annulled. A decision will be made based on an internal investigation. All actions on such events are temporarily frozen until completion.
6.6. If a participant withdraws from a promotion, tournament, or draw before it starts, all bets, bonuses, and related accruals will be canceled.
6.7. If a player withdraws from a tournament or multi-stage activity after starting, all actions and bets made before the last participation stage remain valid; subsequent ones are annulled.
6.8. If a live game or studio session lacks an expected element (e.g., dealer, bonus feature), and the game was advertised to include it, winnings are calculated with a coefficient of "1" unless otherwise stated.
6.9. If a game is canceled by the provider before it begins, all bets are annulled. If interrupted and postponed, bets remain valid until the session is completed or officially canceled. Refunds are made if completion is impossible.
6.10. If conditions change during a tournament or draw (e.g., different studio participants or format change), bets placed before such changes are canceled.
6.11. In team or paired live games, if a participant is replaced, the primary outcome bet remains valid unless the participant list was stated as critical in the terms.
6.12. If the participant list was specified in advance and changes occur, bets are recalculated with a coefficient of "1". Otherwise, sessions continue normally.
6.13. In location-based draws (e.g., live games with "main" or "additional" studio labels), changing the location does not affect bet validity unless stated otherwise.
6.14. For games where "main participant" and "guest" roles are not applicable (e.g., slots, crash games), changing providers, interfaces, or streaming locations does not affect bet validity.
6.15. In "demo tournaments" and unofficial events (fan content, promotional draws), location changes do not affect bet validity.
6.16. Games and events without specific settlement descriptions (e.g., new releases, non-standard formats, unique bonuses) are subject to the General Rules outlined here.
6.17. In any disputes or unusual cases without analogs, the final decision is made by the UpWin platform administration.
6.18. If information discrepancies about a session arise (e.g., interface results vs. provider logs), the company reserves the right to suspend winnings until a full internal review. If provider data and live video recording differ, the video recording prevails.
6.19. If a software error related to the display of bets, winnings, or multipliers is officially recognized, all affected sessions will be settled with a coefficient of "1" and refunded.
7. Parties
7.1. All provisions using the pronouns "we," "us," "our," or "the Company" refer to the company registered in Curacao, providing access to the UpWin platform, with whom the Client enters into an agreement as per Section 1 of this document.
8. Changes to the Terms
8.1. UpWin reserves the right to amend this User Agreement for commercial, legal, operational reasons, or to improve customer service. Changes take effect upon publication on the official website. The Client is personally responsible for regularly reviewing the current version. The Company may modify platform functionalities, game rules, interfaces, available services, and other parameters without prior notice.
8.2. In case of disagreement with the changes, the Client must cease using the platform and close their account. Continued use after the changes take effect constitutes full and unconditional acceptance of the new terms, regardless of personal notification.
9. Right of Claim and Jurisdiction Restrictions
9.1. Access to the UpWin platform is allowed only for individuals who are at least 18 years old or of legal age according to their jurisdiction's laws. The Company may request documents to verify age. Refusal may lead to temporary or permanent account suspension.
9.2. Playing from prohibited territories is forbidden. Detection of jurisdiction violations will result in immediate account blocking without the possibility of funds withdrawal.
9.3. UpWin cannot guarantee that gambling participation is legal in the Client’s jurisdiction. The use of the site’s services is at the Client’s own initiative and risk. The Company does not provide legal advice regarding local gambling legality.
9.4. The Company does not offer services violating the Client’s country's laws. By accepting the Agreement, the Client confirms verifying the platform’s legality within their jurisdiction. The Company bears no responsibility for local law violations by the user.
9.5. Prohibited jurisdictions: UpWin does not accept users located in the United States, Canada, the United Kingdom, Spain, Latvia, Lithuania, Netherlands, France, Switzerland, Albania, Barbados, Pakistan, Syria, South Sudan, Cayman Islands, India, Jamaica, North Korea, Malta, Panama, United Arab Emirates. Residents or persons located in these countries cannot open accounts, deposit funds, or participate in games. The list may be updated without prior notice. Attempts to bypass restrictions via VPN, fake documents, anonymous payment systems, etc., are forbidden and may result in account blocking without fund withdrawal.
9.5.2. 9.6. Betting and Participation are Not Accepted:

9.6.2. From persons prohibited from gambling by their residence or location country's laws.
9.7. Responsibility for Violations
The Client bears full responsibility for violations of Section 9.5. If such violations are detected, UpWin reserves the right to:
- annul all active and completed gaming sessions;
- refuse payment of winnings;
- refuse refunding deposits;
- irreversibly block the account.
The Company may apply sanctions at any moment upon discovering violations.
9.8. Fraudulent Activities
If the Client engages in activities classified as fraud, including but not limited to:
- creating multiple accounts (multi-accounting);
- using third-party software for game automation;
- participating in arbitrage schemes;
- non-purposeful use of the account (e.g., bonus abuse);
- abuse of loyalty programs, bonuses, cashback promotions;
UpWin reserves the right to cancel such sessions, annul all winnings and bonuses, and permanently close the gaming account without refund obligations.
10. Account Opening
10.1. To gain full access to the UpWin platform, the Client must create a personal gaming account. Registration can be completed via "one-click" registration or by entering an email address, creating a password, and subsequently providing personal data: full name, phone number, and date of birth.
10.2. It is necessary to provide a valid and active email address during registration. If "one-click" registration is selected, email verification must be completed later through the profile.
10.3. To verify the accuracy of the information, the Company reserves the right to request identity documents from the Client. Refusal or ignoring the request may result in restrictions, freezing, or blocking of account access until documentation is provided.
10.4. The Client confirms that the information provided during registration is accurate and up-to-date. Any changes must be immediately updated in the Client's profile. Failure to comply may result in account restrictions, temporary blocking, cancellation of winnings, and inability to withdraw funds.
10.5. If questions or difficulties arise during registration, the Client may contact customer support via online chat.
10.6. Each Client is allowed to register only one gaming account. Duplicate registrations are considered attempts to deceive and are subject to account closure.
10.6.1. The Company reserves the right to:
- not refund deposits and bets made from duplicate or related accounts;
- reclaim all winnings, bonuses, and other funds obtained through such accounts;
- block all related accounts without the possibility of recovery.
11. Identity Verification (KYC)
11.1. The name and date of birth specified in the gaming profile must match the Client's official documents.
11.2. The name entered during registration must match the owner’s name of all payment methods used on the UpWin platform — including bank cards, e-wallets, and other deposit/withdrawal methods.
11.3. For identity, residence, and/or payment verification, UpWin reserves the right to request the following documents at any time:
- 11.3.1. Identity document (e.g., valid passport or national ID);
- 11.3.2. Proof of residence (e.g., utility bill or bank statement not older than 3 months);
- 11.3.3. Proof of payment ownership (e.g., bank letter regarding the card used for deposits/withdrawals, not older than 3 months).
11.4. If the Client fails to provide the requested documents or if the information cannot be verified within a reasonable time, the Company reserves the right to:
- 11.4.1. temporarily block the account until successful verification;
- 11.4.2. annul all or part of transactions, freeze the balance, or completely close the account and terminate the Agreement.
11.5. The Company may initiate a security check at any time, verifying data (age, identity, payment methods, registration info) and monitoring compliance with this Agreement. This aims to prevent illegal activities, fraud, money laundering, and other violations.
11.6. The Client agrees that the Company may request information from third-party organizations (e.g., verification service providers, banks, anti-fraud platforms) and disclose necessary information to verify Client data.
11.7. The Client agrees to provide additional documents or information upon request for security checks or compliance with regulatory requirements.
11.8. Verification procedures comply with international gambling and financial regulations, including AML (Anti-Money Laundering), CTF (Counter-Terrorism Financing), internal Company policies, and National regulations for suspicious transaction monitoring.
11.9. Providing forged or false documents during verification is prohibited. Detection of discrepancies will result in account blocking.
12. Username, Password, and Security
12.1. After registering on the UpWin platform, the Client must keep their login credentials (username and password) confidential and must not share them with third parties. If access is lost, recovery is possible via the "Forgot Password" form on the site.
12.2. The Client is fully responsible for account security, including password protection, and for all actions performed from their account. All operations carried out using the username and password are deemed to be performed by the Client.
12.3. In case of suspected hacking, compromised access, or other security breaches, the Client must immediately notify UpWin customer support. If necessary, the Company may request supporting documents or explanations. The Company is not responsible for losses incurred due to negligence in storing login credentials or actions by third parties.
13. Deposits, Account Funding, and Withdrawals
13.1. To participate in games, the Client must fund their gaming account through the available payment methods listed on the site.
13.2. The Client confirms and accepts:
- 13.2.1. All funds deposited are of legal origin and not connected to money laundering or other illegal activities;
- 13.2.2. The Client will not initiate chargebacks, recalls, or cancellations of completed transactions, which may result in account blocking and possible reporting to authorities.
13.3. Deposits must be made only from the Client’s own bank cards, payment systems, or accounts. Third-party payments are prohibited and may result in winnings annulment.
13.4. For withdrawal requests via bank transfer, all associated fees are borne by the Client.
13.5. UpWin does not accept cash deposits. All transactions must go through licensed electronic payment services and financial institutions, and the Client agrees to their terms unless they contradict this Agreement.
13.6. The Client must not dispute or reverse completed transactions. If such action occurs, the Client must reimburse UpWin for the full transaction amount and any associated costs.
13.7. The Company reserves the right to:
- block the Client’s account;
- annul winnings;
- initiate recovery of winnings—
13.8. The Company may use the Client's balance to cover debts arising from duplicate accounts, rule violations, unfair advantage actions, or errors.
13.9. The Client acknowledges that the gaming account is not a bank account: no guarantees, interest, or deposit insurance applies.
13.10. Withdrawals are allowed if:
- all deposits have been verified successfully;
- the Client has completed all required verifications.
13.11. Withdrawal processing conditions include:
- 13.11.1. A fully completed and verified profile;
- 13.11.2. Mandatory KYC for withdrawals over €1000;
- 13.11.3. Processing fees if funds were unused for gaming;
- 13.11.4. Withdrawals up to €1000 processed within 1 to 60 minutes;
- 13.11.5. Withdrawals above €2000 processed within 5 business days;
- 13.11.6. Possible additional delays up to 3 business days.
13.12. Currency exchange services are not provided. In case of account misuse, UpWin reserves the right to:
- withhold a processing fee equivalent to incurred costs;
- annul all transactions on the main and duplicate accounts;
- refuse refunds of deposits made through such accounts.
13.13. To activate withdrawal functionality, the Client must wager at least 4000% of each deposit amount across platform games.
13.14. For withdrawals to accounts not registered in Curaçao, the transfer is considered international and subject to a 20% tax. Currently, the Company covers 50% of this tax, requiring the Client to pay only 10% before withdrawal processing.
13.15. If the Client's winnings exceed €50,000, the Company reserves the right to set a personalized daily withdrawal limit.
13.16. The maximum account balance is limited to no more than 100 times the initial deposit. If exceeded, the Company may adjust the balance accordingly.
14. Terms and Conditions Related to Payment and Use of Services
14.1. The Client agrees to pay for all services and/or products ordered, including but not limited to:
- gaming services,
- access to gaming mechanics,
- additional options and features,
- payment system fees,
- all applicable taxes, duties, and charges (if applicable).
Once the "Pay" button is clicked, the transaction is considered complete, and the funds are irrevocably deducted. By clicking the button, the Client agrees not to initiate a chargeback through the bank or payment system. By placing an order or topping up the account, the Client confirms that:
- they do not violate the laws of their country of residence,
- they are the lawful holder of the payment card or other payment method,
- they are entitled to use the services offered on the UpWin platform.
14.2. By using gaming services, the Client legally confirms that they have reached the legal gambling age in their jurisdiction. The Company reserves the right to request proof of age at any time.
14.3. The use of platform services is solely at the Client’s initiative, and they bear personal responsibility for compliance with local laws. The payment provider is not responsible for illegal use of the service or any violations of local or international laws. All payments related to the Website’s functionality are final. Refunds for services rendered are not provided. Service termination can be requested through the Client’s personal account.
14.4. The payment provider is not responsible for:
- payment failures due to issuer bank refusal,
- errors in payment card processing,
- the quality, quantity, or price of purchased services,
- restrictions related to the Client's payment card.
14.5. If the Client disagrees with these terms or for any other reason, they must refrain from making a payment and, if necessary, contact UpWin support via online chat or phone.
14.6. The use of anonymous payment systems that hide the identity or source of funds is prohibited. Detection of such activity will result in account blocking without the possibility of funds withdrawal.
15. Collusion, Fraud, Misleading Actions, and Criminal Activity
15.1. UpWin advises Clients against gaming activities coordinated with other users from the same IP address or local network or based on prior agreements. Such actions may be considered collusion, fraud, or misleading behavior.
15.2. The Company is not responsible for the timing of the discovery of violations. Upon detection of collusion or fraud, the Company reserves the right to:
- 15.2.1. annul all related transactions and withhold deposits and winnings obtained through coordinated Client actions;
- 15.2.2. demand the return of all funds, bonuses, and winnings obtained through collusion. The Client must comply upon the first notification from the Company.
15.3. The following activities are strictly prohibited:
- 15.3.1. sharing gaming or betting information with third parties;
- 15.3.2. abusing bonus programs (bonus laundering attempts result in account blocking without fund withdrawal);
- 15.3.3. any illegal activities, including fraud, use of bots, exploits, malware, or platform errors;
